Privacy Policy and End User Agreement
This End User License Agreement (the "Agreement") becomes a binding contract between an IONU user (“User”) and INOU Security, Inc. (“IONU” and the “Company”) (a) when you click on the "ACCEPT” button, or similar language or when you accept the Agreement by other means (b) if you are acquiring the IONU applications from an internally deployed mechanism that exists within a corporate entity. If you do not wish to be bound by the Agreement, you cannot access, use or download IONU’s applications. Please read this entire Agreement before agreeing to be bound by its Terms and Conditions.
Services:
In order to use IONU’s Services (“app” or “apps”), the user is required to download the IONU app onto your device(s). In order to begin using IONU’s services, you will need to follow the steps in during the provisioning process. Once your device(s) are provisioned, you will be able to use IONU’s applications, products or services as described below. IONU offers two levels of service: (1) the free IONU app and (2) the IONU Pro app. You can upgrade to IONU Pro version of the app at any time to have access to all the applications features. User Privacy and Private Information Protection
IONU understands that security as an underlying technology that enables personal privacy and data protection. IONU has developed advanced security technology into our system architecture, applications products, services and business strategies. As security experts, IONU understands that no technology is ever perfect, needs to continually evolve and that the potential for breaches and attacks will always exist. IONU continuously improves the IONU system and underlying protection strategies in order to provide the highest levels of protection. In the event of a breach or attack on a user’s private data, any data collected would be encrypted with keys that would not be available for decrypting the collected data.
User Responsibilities:
IONU is committed to helping you keep your private information protected and your data secure. Providing this level of privacy and information protection requires that the User assume certain User Responsibilities. Users are required to create a unique username and password. The username and password are required fields to create a user account and access the capabilities of IONU’s applications. To ensure user privacy and security, it is important to note that IONU will never store or know your password. For this reason, it is extremely important for users to remember their password, as IONU will not be able to reset or retrieve a user’s password or provide access to a user account for user that has lost or forgotten their password.
Additionally, during the user enrollment and device provisioning process, a user will need to answer three (3) security questions. These security questions will be required to enroll and provision additional devices to a user’s IONU account. Just like the user password, IONU will never know or store the answers to the security questions. This is to protect a user’s privacy and private data.
If a user is unable to recall their password and/or the three (3) security questions, IONU will not be able to retrieve any of the information that exists in that User’s IONU account.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event will IONU, its suppliers or partners, be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of personal business information, or any other pecuniary loss) arising out of (1) the use, misuse or inability to user the Service, (2) the use of, misuse of or inability to use, the Service; (3) the performance of the services and materials available from the Service; or (4) the conduct of other users of the Service, even if IONU has been advised of the possibility of such damages. Users assume total responsibility for their use of the Service with their only remedy against IONU for dissatisfaction with the Service being to stop using the Service.
Unauthorized Use:
In addition to other limitations set forth in this Agreement, by using the Service, users agree not to: (1) use any data mining, robots, or similar methods of data collection in connection with the Service; (2) interfere with the operation of the Service or with any other person’s use of the Service; (3) impose an unreasonable burden on the Service or network; (4) breach, or attempt to breach, the security of the Service; (5) gain unauthorized access to the Service or any part thereof; (6) use the Service for any purpose that is beyond the scope of the Service’s expected use, illegal or prohibited by these Terms; (7) to solicit any activity, unlawful or otherwise, that infringes IONU’s rights or the rights of any other party; and (8) use the Service to transmit: spam, junk email, bulk email, promotions, or other solicitations, content that includes any advertising or marketing materials; content that may be deemed unlawful, threatening, harassing, racist, abusive, libelous, pornographic, vulgar, defamatory, obscene, indecent, or otherwise inappropriate, including any messages constituting or encouraging criminal conduct; content that violates or infringes on our legal rights or copyrights, or the legal rights or copyrights of others; or viruses, bugs, worms, or any other computer code that may harm a network, computer, server, hardware, software, or telephone equipment.
User Codes of Conduct
IONU is committed to making all reasonable efforts to ensure user safety. Although now company can assure safety of its users, IONU wants you to be able to voice your concerns. If you are aware of, have personally experienced or witnessed any defamatory, obscene, threatening, harassing, racist or abusive behavior or content. Or, have been introduced to any pornographic, obscene, indecent, rude or distasteful invitations, messages, content or images, while using the IONU Services, please send an email with a description of what you feel is inappropriate to misconduct@ionu.com.
Indemnification:
You agree to defend, indemnify and hold harmless IONU, its officers, shareholders, directors, employees, agents, subsidiaries, affiliates, licensors and suppliers from and against any and all claims, charges, complaints, damages, losses, liabilities, costs and expenses (including attorneys’ fees) due to, arising out of or relating in any way use of the Service.
Disclaimer:
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE SERVICE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. THE SERVICE AND CONTENT ON THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICE, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. WE DO NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SERVICE, THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED BY THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY SERVICE WILL CONTINUE TO BE MADE AVAILABLE, THAT DEFECTS IN THE SERVICE WILL BE CORRECTED, OR THAT THE SERVICE WILL BE COMPATIBLE OR WORK WITH ANY THIRD PARTY SOFTWARE, APPLICATIONS OR THIRD PARTY SERVICES. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR AN APPROVED REPRESENTATIVE SHALL CREATE A WARRANTY.
ALL INFORMATION PROVIDED THROUGH THE SERVICE IS SUBJECT TO CHANGE WITHOUT NOTICE. IONU CANNOT ENSURE THAT ANYTHING YOU DOWNLOAD FROM THE SERVICE WILL NOT CONTAIN VIRUSES OR OTHER DESTRUCTIVE ELEMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
Terms of Service:
IONU reserves the right, at its sole discretion, to establish and amend the general operating practices, procedures and Terms and Conditions contained in this Agreement that govern the operation and availability of the Services for the greatest benefit of both its users and the Company.
If an user of the IONU is deemed to have violated the policies set forth in this Agreement, IONU reserves the right, at its sole discretion to freeze, cancel and/or purge your account with or without notice. IONU may at any time cease to provide the Service to a user for any reason including without limitation your violation of these Terms.
By registering for IONU Services, you acknowledge and agree that your IONU account and access to your data may not be available at certain intervals in order for IONU to perform performance maintenance on its servers, or other reasons beyond the control of IONU.
